General terms and conditions for the WEAR STORE website of WE R MONKEY BVBA
These general terms and conditions apply to all transactions concluded online with WE R MONKEY BVBA online. Please read them carefully before placing an order. All agreements are subject to and shall be interpreted in accordance with Belgian law. Moreover, all disputes between us shall be settled exclusively by the Belgian courts. Nothing in these general terms and conditions shall be deemed to affect your statutory rights.
By using this website, you agree to these terms and conditions. All transactions with WE R MONKEY BVBA are subject to these terms and conditions.
The words "the company", "we" or "us" always refer to WE R MONKEY BVBA. Customer" always refers to the person or persons who purchase goods from the Company or agree to purchase goods from the Company. Any reference to the website implies a reference to all URLs owned by WE R MONKEY BVBA.
All prices are in euros. They include VAT at the applicable rate, unless clearly stated otherwise. All prices are subject to change without notice.
To purchase a product, you must first add the product to your shopping basket. If you have added the desired products to your shopping basket, you can enter your contact details and billing details. Then you must provide us with the necessary information to pay for the products. If we have received all the previous data, you will receive a summary page. If you accept this, your purchase is final. The purchase contract can be concluded in the language of the website in which you are purchasing.
We accept orders via online transactions (secure server). All credit and debit card transactions are subject to validation checks and approval by the card issuer. We accept Visa, MasterCard, Maestro, Bancontact/Mister Cash. If the issuer of your card refuses to approve your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
Please note that minors (under 18 years of age) should not make the purchase unless they have permission from their parents or guardian.
Products ordered shall be delivered as quickly as possible in accordance with the requested delivery method. All delivery charges are subject to change without prior notice. We will do everything possible to ensure that you receive your order within the estimated delivery period. The maximum delivery period is 30 days from the day after your order was placed. All goods are delivered subject to availability. Promotions always run for the period indicated or while stocks last. If we are unable to deliver your goods within 30 days, we will notify you immediately and inform you of the expected delivery date. If we are unable to deliver the goods within 30 days, you may cancel the undelivered orders / products at any time after you have been notified of the late delivery. If payment has already been made, you will receive a full refund for the item(s) in question. If the goods delivered by us were damaged in transit, do not match the items listed on the delivery note or do not match the items you ordered, you must notify us and return the items to us within 15 calendar days of receipt. If we do not receive such notification, the customer shall be deemed to have accepted the items as satisfactory. We cannot be held responsible for any consequential loss due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases shall be limited to the value of the items proven not to have been received by the customer.
- Return and exchange items
We want you to be completely satisfied with every purchase from WE R MONKEY BVBA and strive to provide you with excellent quality, value for money and service at all times. If you wish to return an item for exchange, or if you have decided not to keep it, please follow the instructions on the postcard received with your delivery and return the products to us in their original packaging and within 15 calendar days.
If you return an item requesting a refund within 16 and 30 days after receiving it, we'll give you a WEAR gift voucher for the amount equivalent to the price you paid for them. We aim to refund you within 14 days of receiving the returned item. If you request a refund for an item during the above time frames but you can't return it to us for some reason, please get in touch. But any refund will be at our discretion.
Please keep in mind that this is not valid for items purchased in the sale, mid-sale or outlet. For these articles you will receive a WEAR gift voucher.
You can always return your items in one of our stores. Our staff there will give you a proof of return and we will arrange the refund as soon as possible.
Of course, it's fine to try an item on like you would in a shop, but please don't actually wear it. If an item is returned to us damaged, worn or in an unsuitable condition, we won't be able to give you a refund and we may have to send it back to you (and ask you to cover the delivery costs). All items are inspected on return. We ask to only return articles in their original condition which means:
- No traces of use
- No worn clothes: no stains, no odors, ...
Hygiene and our customers’ safety is super important, so certain items can’t be returned for refunds including:
- Face + Body products if opened, used or protective seal is not intact
- Underwear if the hygiene seal is not intact or any labels have been broken
- Swimwear if the hygiene seal is not intact or any labels have been broken
- Pierced jewelry
- Mouth masks
If you wish to return an article because it is damaged, please let us know by e-mail. Send us a description of the damage and send the article back to us in its original packaging within 15 calendar days. If appropriate, we will exchange the item or refund the full cost, including all delivery costs incurred.
Returned items are your responsibility until they reach us, so make sure they're packed up properly and can't get damaged on the way. As the parcel remains your responsibility until it arrives back with us, ensure that you get proof of postage in case you need to contact us about your return.
We're not responsible for any items that are returned to us by mistake (it happens!). If we're able to locate the items (it's not always possible) and you'd like these returned to you, we may ask you to cover the delivery cost.
We're also not responsible for returned items that get lost on their way back to us.
If you've received a faulty or incorrect item, please send it back to us and we'll refund you as soon as it arrives back at our warehouse. Please contact our customer care.
All products are guaranteed against defects caused by manufacturing or material faults. Please return that item as soon as possible to our warehouse or one of our stores to get your refund. All reported defects will be assessed by us and the supplier. Defects caused by accidents, negligence or misuse are not refunded.
If you have received a product in a damaged condition, please notify us first. You can contact us at firstname.lastname@example.org. We will see how we can offer a solution and will ask you to return the item. The return costs will be refunded (according to the standard postal rates). Send the damaged product, together with a description of the damage, postage paid to our return address. Please also include your bank account number so we can make the refund.

Please also clearly indicate what is wrong with the purchased product or indicate where something is wrong. All items should be returned to us in clean and orderly condition, so that we can help you as quickly as possible.
All products are sold alone, unless otherwise stated, and are not always available in every retail outlet. Every effort is made to ensure that the colors on the website match those of the actual product as closely as possible. Due to technical limitations, some colours may vary.
- Distance selling regulations
In accordance with the Distance Selling Regulations, you have the right to cancel any order you have placed through the Website for a refund within 14 calendar days of the day after the delivery date, provided the goods are unused. This does not apply to perishable goods, unsealed software or items that have been personalized or created according to your instructions.
To cancel an item, please send us an e-mail message at email@example.com informing us of your customer number and the number of the order. You must take reasonable care of the items and keep all original packaging, and you must not use the items. Items must be returned within 14 calendar days of you sending us your cancellation notice. They can be returned to our Customer Service Department (see contact details). All items will be returned at your expense. If the items are damaged or incorrect, we will refund the cost upon receipt of the items. If we receive the items in unused condition and in their original packaging with all accessories, you will receive the refund within 30 days of your cancellation notice.
- Force majeure
We shall not be responsible for any failure to fulfil our obligations if this is due to, or caused by, labour disputes or any other circumstances beyond the company's reasonable control, such as cases of force majeure, riots and disturbances, flooding, fire, strike, lock-out, difficulties in finding transport and the enactment of laws. If, due to such circumstances, it becomes impossible for the company to deliver all or part of the ordered items within a reasonable period of time, the liability of the customer shall be limited to the value of the items already delivered plus any associated delivery costs.
Any information included on our website or displayed on any of the Company's printed materials is not considered to be mandatory or recognized as best practice. It should only be considered as useful additional advice alongside other recognized codes of practice. All information on our website is updated regularly.
- Prices and printing errors
We check prices and specifications to the best of our ability. While we make every effort to ensure that they are correct, we do not accept responsibility for errors and omissions. We reserve the right to change our prices and specifications without prior notice.
Please keep in mind that the price in our cashier system is always the right one.
- Ownership of goods
All articles delivered to the customer remain the property of WE R MONKEY BVBA until we have received payment of all amounts due for the items in question.
- Questions or complaints
All questions, complaints or comments can be sent to our customer service department at firstname.lastname@example.org. We will make every effort to deal with your complaint within 5 working days of receipt. If we are unable to resolve your complaint immediately, we will inform you of the probable timeframe. We will keep you informed of any investigation.
You can also report complaints and disputes via the European ODR (Online Dispute Resolution) Platform. The ODR website is http://ec.europa.eu/odr.
We make every effort to ensure maximum security for users of our online ordering service. We use secure socket layer technology (SSL) to secure your data during all sales transactions with us. All information you provide is fully encrypted so that third parties cannot read it. - Right of withdrawal
You have the right to withdraw from the contract within a period of 14 days without giving any reason. The withdrawal period shall expire 14 days from the day on which you or a third party designated by you and other than the carrier acquires physical possession of the last good.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We shall reimburse you using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you shall not be charged for such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
You shall return the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your decision to withdraw from the contract to us. You are in time if you send back the goods before the period of 14 days has expired.
